Weekly Liverpool BPC applications list

Now that a resident Business and Property Court Judge for Liverpool has been appointed, a weekly Business and Property Courts applications list will be heard on Mondays at 10am before HHJ Cadwallader sitting as a High Court Judge. This will start on 25th January 2021.

The list will be suitable for interim applications in the Business and Property Courts, including in particular the Business List (ChD), the Insolvency and Companies List (ChD), the Property Trusts and Probate List (ChD), the Circuit Commercial Court (QBD) and the Technology and Construction Court (QBD).

The applications should require the attention of a High Court or s.9 Judge. An application should not be listed in the applications list if it is suitable for hearing by a District Judge.

The overall time required to deal with the application in this list should ordinarily be 2 hours or less, including the hearing of the application, delivery of judgment and time for dealing with costs. Depending on their urgency, however, longer applications may also be entertained in this list; or they may be listed before another judge, or case managed and listed as an interim application by order, as appropriate.

Urgent applications that cannot wait for the applications day will continue to be listed as soon as possible (and, if necessary, out of hours).

In view of the current pandemic, it is anticipated that all matters in the applications list will be heard remotely, and not face to face.
