Making more complex applications in the Court of Protection – tax planning, gifting, statutory wills, equity release, trustee removal

The Court of Protection has been seen by many as being required only for the appointment of a deputy, however, it has a much broader remit and a number of applications can be brought under it, and the procedures are very different from a “straightforward” deputyship application.

This online seminar will explain when the court can get involved and some of the more complex applications that can be brought within the same.

It will provide you with practical advice on the procedures and problems that have been faced in the past by practitioners, including recent case law on the subject to highlight the pitfalls.

Speaker Biographies

Helen Forster is a solicitor and Trusts and Estates Practitioner. Since qualifying in 2009, she has specialised in Wills, Probate, Trusts, Tax and Court of Protection matters, and is a Dementia Champion with Age UK, a member for Solicitors for the Elderly and also a member of STEP (The Society of Trusts and Estates Practitioners). She also teach night classes at Rossett School Adult Learning in Harrogate, giving individuals an insight into how legal documents such as Lasting Powers of Attorney are drafted, as well as pitfalls and problems.

Over her career she has been highly commended twice in the Yorkshire Legal Awards, as well as receiving an award for second place in the Modern Law Awards 2016 in the category of “Rising Star” in England and Wales. More recently HTF legal has been awarded “Best Wills and Probate” firm in Yorkshire in 2023.
